1. Acceptance of Terms
These Terms of Use constitute a legally binding agreement between you and Heraventos governing your access to and use of the website located at heraventos.com and all associated services, features, content, and applications. Your continued use of the platform constitutes ongoing acceptance of these Terms as they may be updated from time to time.
2. Definitions
- Platform — the Heraventos website, applications, and all related services available at heraventos.com.
- User — any individual or entity that accesses or uses the Platform.
- Account — a registered profile created by a User to access protected features of the Platform.
- Content — any text, images, video, audio, data, or other material made available through the Platform.
- Services — all educational offerings including group sessions, individual lessons, learning programs, and interactive tools provided by Heraventos.
- Instructor — any qualified individual authorized by Heraventos to deliver educational content or sessions on the Platform.
3. Eligibility
You must be at least 16 years of age to create an Account or use the Services independently. Users between the ages of 13 and 15 may access the Platform only with verifiable parental or guardian consent. By using the Platform, you represent and warrant that you meet these eligibility requirements. Heraventos reserves the right to verify eligibility and suspend or terminate accounts that do not comply.
4. Account Registration and Security
4.1 Registration
Certain features of the Platform require you to create an Account. You agree to provide accurate, current, and complete information during registration and to keep your information updated at all times.
4.2 Credentials
You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your password with any third party. Heraventos will not be liable for any loss or damage arising from unauthorized use of your Account resulting from your failure to protect your credentials.
4.3 Notification
You agree to notify Heraventos immediately at info@heraventos.com if you become aware of any unauthorized access to or use of your Account.
5. Permitted Use
Subject to these Terms, Heraventos grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial educational purposes. You agree to use the Platform only in accordance with these Terms and all applicable laws and regulations.
6. Prohibited Conduct
You agree not to engage in any of the following activities:
- Copying, reproducing, distributing, or exploiting any part of the Platform or its Content without prior written authorization from Heraventos.
- Reverse engineering, decompiling, or attempting to extract the source code of any part of the Platform.
- Using automated tools, bots, scrapers, or data harvesting methods to access or collect information from the Platform.
- Uploading, transmitting, or distributing any material that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
- Interfering with or disrupting the integrity, performance, or security of the Platform or its infrastructure.
- Attempting to gain unauthorized access to any portion of the Platform or any systems or networks connected to it.
- Sharing, reselling, or sublicensing access to Services or Account credentials to third parties.
- Using the Platform to send unsolicited communications or to engage in any form of spamming or phishing.
- Engaging in any conduct that could damage the reputation or business interests of Heraventos.
7. Educational Content and Sessions
7.1 Nature of Content
All educational content, learning paths, and sessions offered on the Platform are intended for informational and educational purposes only. Heraventos does not guarantee specific outcomes, results, or professional certifications unless explicitly stated in a specific program description.
7.2 Session Scheduling and Cancellation
Users must adhere to scheduled session times. Cancellations or rescheduling requests must be submitted in accordance with the cancellation policy communicated at the time of enrollment. Heraventos reserves the right to modify, reschedule, or cancel sessions due to instructor unavailability or unforeseen circumstances, with reasonable notice provided to affected Users.
7.3 Code of Conduct in Sessions
Users are expected to conduct themselves professionally and respectfully during all live sessions. Disruptive, abusive, or inappropriate behavior may result in removal from a session and suspension or termination of your Account without refund.
8. Intellectual Property
8.1 Ownership
All content available on the Platform, including but not limited to course materials, videos, graphics, text, software, and trademarks, is the exclusive property of Heraventos or its licensors and is protected by applicable intellectual property laws.
8.2 Limited License
You are granted a limited, personal, non-transferable license to access and view Platform Content solely for your own educational use. No Content may be downloaded, stored, reproduced, transmitted, or used for any commercial purpose without express written permission from Heraventos.
8.3 User Submissions
If you submit any content, feedback, ideas, or materials to the Platform, you grant Heraventos a worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, modify, publish, and distribute such submissions in connection with the operation and improvement of the Platform, without any obligation of compensation to you.
9. Payments, Fees, and Refunds
9.1 Pricing
Fees for specific programs, sessions, or subscriptions are displayed on the Platform and are subject to change. All prices are listed in the applicable currency and are inclusive of any taxes where required by law.
9.2 Payment Processing
Payments are processed through third-party payment providers. By submitting payment information, you authorize Heraventos to charge the applicable fees using your selected payment method. Heraventos does not store full payment card details.
9.3 Refund Policy
Refund eligibility is determined on a per-program basis and is communicated prior to purchase. Unless otherwise stated, fees for completed sessions or consumed content are non-refundable. Requests for refunds must be submitted to info@heraventos.com within the timeframe specified in the applicable program terms.
10. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. Heraventos does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party services. Your interactions with third-party services are governed by their respective terms and policies.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your information as described in the Privacy Policy.
12. Disclaimers
The Platform and all Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Heraventos expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Heraventos does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Heraventos and its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform, including but not limited to loss of data, loss of profits, or loss of business opportunities, even if Heraventos has been advised of the possibility of such damages.
In no event shall Heraventos's total aggregate liability to you for all claims arising out of or relating to these Terms exceed the total amount paid by you to Heraventos in the twelve months preceding the event giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Heraventos and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
15. Termination
15.1 Termination by User
You may terminate your Account at any time by contacting Heraventos at info@heraventos.com or through your account settings, where available. Termination does not entitle you to a refund of any unused fees unless otherwise specified in the applicable program terms.
15.2 Termination by Heraventos
Heraventos reserves the right to suspend or terminate your Account and access to the Platform at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your right to use the Platform ceases immediately.
16. Modifications to Terms
Heraventos reserves the right to update or modify these Terms at any time. When changes are made, the "Last Updated" date at the top of this page will be revised. If changes are material, Heraventos will make reasonable efforts to notify registered Users via email or through a prominent notice on the Platform. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the updated Terms.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution cannot be reached informally, disputes shall be submitted to binding arbitration or a competent court, as applicable under relevant law.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible.
19. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and Heraventos with respect to your use of the Platform and supersede all prior agreements, understandings, and representations relating to the same subject matter.
